How to submit a copyright takedown notice

To file a copyright takedown request, send a written notice that contains the following information. Providing complete information will speed up our review and response.

Required information for a proper notice

  1. Your full legal name and a contact email address, and a telephone number.
  2. A description of the copyrighted work you claim is infringed (title, author, registration number if available).
  3. Identification of the material you claim is infringing, including a URL or exact location on wellcend.com where the material appears.
  4. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
  6. A physical or electronic signature of the copyright owner or the person authorized to act on behalf of the owner.

Where to send your notice

Email the notice to our copyright agent at: info@wellcend.com with the subject line: DMCA Takedown Request.

We will respond to acknowledge receipt and notify the user who posted the content, if applicable. If we determine the notice is valid, we will remove or disable access to the allegedly infringing material.

What happens after you send a notice

  • Acknowledgement. We will send an acknowledgement email when we receive your notice.
  • Preliminary review. We will check the notice for required elements. If incomplete, we may request additional information.
  • Action. If the notice is valid, we will remove or disable access to the content.
  • Notice to poster. We will notify the user who posted the material and provide a copy of your notice.
  • Counter-notice option. The poster may submit a counter-notice if they believe the removal was mistaken or the content is authorized. See the section below.
  • Restoration. If we receive a timely, valid counter-notice, we may restore the content unless the claimant files a court action to restrain the poster.

We will keep records of notices and actions for our records and to comply with applicable law.

How to submit a counter-notice

If you believe material was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice. Please include the following:

  1. Your full legal name, contact email, and telephone number.
  2. Identification of the material that was removed, with the exact location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of a mistake or misidentification.
  4. A statement consenting to the jurisdiction of the federal district court in which your address is located, or, if you are outside the United States, an equivalent statement that you will accept service of process from the person who provided the original notice.
  5. Your physical or electronic signature.

If a counter-notice is valid and the original claimant does not file a court action within 10 to 14 business days, we may restore the content.

Repeat infringer policy

We comply with the Digital Millennium Copyright Act and will terminate accounts of users who are repeat infringers. Repeat infringement is assessed at our discretion based on prior notices, verified counter-notices, and the severity of infringement.

  • Wellcend does not provide legal advice. If you are unsure about your rights or how to proceed, consult a lawyer experienced in copyright law.
  • False claims. Submitting false or fraudulent claims may expose you to liability. Please ensure the information in your notice is accurate.

Record keeping and transparency

We keep records of all notices and counter-notices, and actions taken, for a minimum of two years. We may publish anonymized statistics about takedown requests in our transparency reports.

International claims and jurisdiction

This DMCA Copyright Notice follows the procedures used in the United States under the Digital Millennium Copyright Act. If you are submitting a notice from outside the United States, please provide equivalent representations required by your jurisdiction. Wellcend will consider notices consistent with local law and will cooperate with appropriate authorities.
